Yes, you can submit a Claim for compensation under the settlement even if you participated in the Loblaw Card Program. You will, however, only be entitled to the amount by which the additional settlement compensation exceeds the $25 Loblaw Card benefit previously received and only if that additional settlement compensation amount is $5 or more.
The definition of the Loblaw/Weston settlement class for the Ontario class action is: All Persons resident anywhere in Canada except Quebec on December 31, 2021, other than Excluded Persons (defendants and related parties), who between January 1, 2001 and December 31, 2021, inclusive, purchased Packaged Bread, either directly or indirectly that was, produced or distributed by a defendant.
If you reside in the province of Quebec, please click HERE.
Class actions have been certified/authorized by the Ontario and Quebec Courts on behalf of residents in Canada alleging that certain manufacturers and retailers of Packaged Bread engaged in anti-competitive conduct resulting in overcharges for Packaged Bread sold in Canada from 2001 to 2021, inclusive.
Packaged Bread is any and all packaged bread products and bread alternatives including, but not limited to, bagged bread, buns, rolls, bagels, naan bread, English muffins, wraps, pita and tortillas, but excluding bread frozen when sold and bread baked on-site in the establishment where it is sold.
The settlement resolves the class actions against the Loblaw/Weston group of defendants for $500 million ($96 million of which was distributed in 2018/19 through the Loblaw Card Program) and Loblaw/Weston’s cooperation to assist the plaintiffs in prosecuting the class actions against the remaining non-settling manufacturer and retailer defendants. In exchange, the class actions are dismissed against Loblaw/Weston and the Loblaw/Weston group of companies have received a full release of all claims against them in relation to Packaged Bread.
The $500 million settlement amount net of the $96 million previously paid through the Loblaws Card Program and the court-approved funder, administration and lawyers’ fees will be distributed in accordance with the provisions of the Distribution Protocol that was approved by the Courts.
The Distribution Protocol provides for 99.5% of the net settlement amount to be allocated for the benefit of eligible residents of Canada who purchased Packaged Bread for personal use anytime between 2001 and 2021, inclusive. Those monies will be distributed through the Claims Process that is now open for Claims to be submitted.
The Distribution Protocol provides for 0.5% of the net settlement amount to be allocated for the benefit of businesses/entities in Canada that purchased Packaged Bread for resale anytime between 2001 and 2021, inclusive. Those monies are being retained in trust at this time. How those monies will be distributed will be determined by the Courts at a future date.

The amount of compensation you will receive cannot be determined at this time. It will depend on the net settlement funds available to distribute, the number of Claims that are approved by the Settlement Administrator, and whether or not you previously received a $25 Loblaw card from the Loblaw Card Program.

No. There is no right of appeal in respect of rejected Claims.
Accurate claims processing takes time. It is typical for payments to be sent 6 to 12 months after the claim deadline. Your patience is appreciated.
Payment will be made by Interac e-transfer by email or, if requested by the claimant, by cheque. Where the claimant elects to be paid by cheque, $2 will be deducted from the compensation payable to reflect the additional cost of providing a cheque.
Interac e-transfer payments to your email can be accepted for a 30-day period from the date they are issued. Cheques may be negotiated for a 6 month period from the date issued. Payments that expire will not be reissued.
